New Delhi: In the terror funding case, the Delhi High Court allowed Yasin Malik to cross-examine through video conferencing during the next hearing. The court has asked Yasin Malik to submit written arguments in the case. The next hearing of the case in the Delhi High Court will be held on September 15 at 3 pm. Yasin Malik had demanded to cross-examine physically in the court during the hearing of the case.
Yasin Malik rejected the court’s suggestion
The court suggested the appointment of an amicus for Yasin Malik, and also suggested that Yasin Malik can suggest the name of a lawyer on his behalf who can cross-examine on his behalf. Yasin Malik refused to accept both the suggestions of the court. Yasin said that he himself will cross-examine through video conferencing during the hearing of the case.
The Delhi High Court said that if Yasin Malik wants, he can challenge the order of August 4 last year in the Supreme Court. Yasin Malik said that he does not want to go to the Supreme Court. He wants to cross-examine the hearing in the case here. However, the division bench said that his presence through VC is mandatory due to security threat in the earlier order of the High Court. The next hearing of the case will be on September 15.
NIA has demanded death penalty from the court
The NIA has appealed against the trial court order sentencing Malik to life imprisonment, who had held him guilty in the case under sections 120B, 121, 121A of the Indian Penal Code (IPC) and sections 13 and 15 of the UAPA read with 120B of the IPC besides sections 17, 18, 20, 38 and 39 of the UAPA. In a detailed judgment in May 2022, the special NIA court found that Malik betrayed the good intentions of the government by choosing the violent path. The judge had also rejected Malik’s plea that he had become a Gandhian after 1994.
