In one of its decisions on Tuesday, the Supreme Court put a stay on the death sentence of a person convicted of rape and murder. The accused had raped and murdered a 19-year-old engineering student in Ranchi, the capital of Jharkhand. The 30-year-old man was sentenced to death after pleading guilty in the case.
What did the apex court say while giving the verdict?
A bench of Justices Surya Kant, Pankaj Mithal and Ujjal Bhuyan sought translated copies of the trial court and high court records of the case. The court also said that there will be a stay on the execution of the death penalty. While giving the order from the registry, the bench directed to obtain the copy of the records from the lower court and the High Court.
This case is of December 15, 2016, when a 19-year-old student was strangled to death after being raped. Then an attempt was made to destroy the dead body by burning it. Three years after the incident, in December 2019, the trial court had sentenced the accused Rahul Kumar alias Rahul Raj to death. Jharkhand High Court had confirmed the sentence on 9 September 2023, upholding the decision of the lower court. Rahul Kumar is a resident of Nawada district of Bihar.
Life imprisonment for murder accused
In another news, a court in Maharajganj district of Uttar Pradesh has sentenced three persons guilty of kidnapping and murder of a minor boy due to old enmity to life imprisonment. The court of Sessions Judge Abhay Pratap held Sagar Madheshiya, Vishnu Madheshiya and Mukesh Madheshiya guilty of murder and sentenced them to life imprisonment. The court has also imposed a fine of Rs 40,000 on each accused.
According to Additional District Government Advocate Purnendu Tripathi, the accused in this case had kidnapped 17-year-old Aman Madheshiya and later strangled him to death. This incident took place in Nichlaul police station area. A case was registered against the accused under sections 364 (kidnapping), 302 (murder), 120B (conspiracy) and 201 (destroying evidence) of the Indian Penal Code (IPC).
